EPA may face legal challenges for its "endangerment" finding

The Environmental Protection Agency's issuance of an "endangerment" finding on the eve of the Copenhagen Climate Change Conference may subject the agency to a slew of class-action lawsuits as a result of the lack of a proper comment period, Douglas Smith writes. He adds that the EPA's brazen action to impose wide-ranging restrictions on greenhouse-gas emissions that the Obama administration can't achieve through legislation shows that the agency doesn't want to put the issue up for discussion.
