U.S. court sides with state in denying water permit for LNG project

An appeals court dismissed AES' petition to review Maryland's rejection of a water-quality permit for the company's planned liquefied natural gas terminal in Baltimore. AES contended that the state failed to rule on the application within one year and that its denial was "arbitrary and capricious" because it viewed water flow as pollution under the Clean Water Act. The court said Maryland studied "relevant data" on the project's effects on water supply "and articulated a satisfactory explanation for its denial on that basis."
