Canadian court: Stating the relationship of parties is key to construction joint ventures

A Canadian court has clarified the criteria that define joint-venture relationships between contractors in that country. The majority of the court found that contractors may deal with one another as members of a joint venture while working with a project owner in a relationship where one contractor acts as subcontractor. How contractors describe their relationship in their agreement is important when deciding whether they are in a joint venture, the majority found.
