Federal appeals court rules against U.S. in dispute with utilities

A federal appeals court in Washington ruled that the Department of Energy cannot cite unavoidable delays in used-fuel collection as a defense in a multibillion dispute with utilities over storage of radioactive waste. The utilities had been ordered by Congress in 1982 to store used nuclear material while the DOE made plans to construct a permanent disposal facility at Nevada's Yucca Mountain. "We've been eagerly awaiting this decision," said Jay Silberg, an attorney for Nebraska Public Power.
