Energy Dept. says collection of waste fees is appropriate

The Department of Energy defended in a court filing its annual collection of $750 million from the nuclear industry to finance the management of the U.S. inventory of used nuclear fuel. A federal appeals court ordered the department to reassess its directive, ruling that an earlier justification was "legally defective." "Neither insufficient nor excess revenues are being collected in order to recover the costs incurred by the federal government," said Energy Secretary Steven Chu.
