BofA continues to defend SEC settlement to judge

District Judge Jed Rakoff, who is overseeing a settlement between the Securities and Exchange Commission and Bank of America, is still questioning whether the SEC should have given more credence to a claim that Timothy Mayopoulos, Bank of America's former general counsel, was fired because he wanted to disclose widening losses at Merrill Lynch. Rakoff will review transcripts of depositions taken by New York Attorney General Andrew Cuomo, whose office filed a separate lawsuit, before making a decision next week about the settlement.
