NVE sues U.S., saying FDA lacked authority to ban ephedra

NVE Pharmaceuticals has filed suit against the U.S. government as part of an attempt to block the FDA's decision to ban ephedra, the herbal supplement blamed for heart attacks and the death of a professional athlete. NVE, which makes Stacker 2 dietary supplements made with ephedra, charged in its New Jersey suit the ban violates a 1994 law restricting the agency's authority to regulate herbal products.
