Lawmakers ask FDA to clarify whether medical apps will be taxed

Lawmakers are expressing concern that an impending tax on medical devices, part of the Patient Protection and Affordable Care Act, could be applied to the tens of thousands of health, fitness and medical applications sold in app stores. Members of the House Energy and Commerce Committee are asking the FDA for clarification. "I think that the FDA is taking their time here, and may be vexed by their own opportunities and risks. They're used to regulating software, but the software that operates the X-ray machine, not mobile apps," said Jon Potter, president of the Application Developers Alliance.
