Nevada Gov. Brian Sandoval has replaced three members of the state's HOA oversight board after they refused to ignore an opinion from the Commission for Common-Interest Communities and Condominium Hotels that said HOAs can recoup fees and costs from foreclosed properties via collection agencies. The attorney general found the commission has no authority to issue such an opinion. The three represented developers, accountants and association managers; those who voted to ignore the opinion represent homeowners and lawyers. Bruce Breslow, director of the Nevada Department of Business and Industry, said the three members were not replaced because of their refusal to pass the motion.
