The key to avoiding liability in a pay-discrimination lawsuit is to document the reasons pay decisions are made, labor-law attorney Leslie E. Silverman said at the Society for Human Resource Management's annual Employment Law & Legislative Conference last week. Employers should keep personnel files related to compensation forever, Silverman said, because of the time provisions in the Lilly Ledbetter Fair Pay Act.
