Congress did not reauthorize a program that provides employers with an online database to verify that a potential employee may legally work in the U.S. Nevertheless, the E-Verify program will continue to receive federal funding through September 2009. Some of its supporters note that employers have confirmed the identity of 5.3 million workers by using the program, but immigration advocates say its database is less than 100% accurate. Employers are not required to use E-verify to confirm the status of workers employed on construction jobs funded by the federal economic-stimulus legislation.
