Attorneys: Pre-emption ambiguous for drug-device combination products

Plaintiffs' attorneys contend that drug-device combination products should not be eligible for federal pre-emption under the the Food, Drug and Cosmetic Act. "There is plenty of room yet to wiggle and combination products provide that wiggle room," said one attorney for pharmaceutical and device companies.
