Ambiguity in Equal Pay Act complicates enforcement, lawyer says

The Equal Employment Opportunity Commission is making equal pay a priority, but ambiguity in federal law is complicating those efforts, lawyer Alison Marshall says. Plaintiffs must show that job positions with different pay are "equal" in order to make a claim under the Equal Pay Act. "The courts have been really focusing on what does it mean to be substantially equal. Equal does not mean identical," Marshall says.
