Supreme Court considers software patents in financial services case

The Supreme Court focused on the issue of software patents Monday in a case involving Australia-based Alice Corp.'s patents for a system to reduce risk in derivatives trades. Several justices seemed to question the validity of Alice's patents, but the court appeared more wary about making a general statement on software patents. Justice Stephen Breyer pointed to the risk that "instead of having competition on price, service and better production methods, we'll have competition on who has the best patent lawyer." However, he also seemed to caution against eliminating software patents.
