Federal judge overturns FDA's ephedra ban

A federal judge struck down the FDA's ban on ephedra weight-loss supplements, saying the agency must follow more restrictive rules in acting against foods as opposed to drugs. In sending the matter back to the FDA for further rulemaking, the judge said the agency is required to prove a supplement is harmful, rather than having the manufacturer prove it is safe, as would be the case if it were a drug.
