Kmart property tax suit is dismissed

The retailer, which emerged from Chapter 11 bankruptcy proceedings in May 2003, had asked a bankruptcy judge to hear a case involving suits against local jurisdictions over property taxes. The judge dismissed the case because Kmart did not demonstrate it met the conditions to be heard by a bankruptcy court, he said.
