A ruling by U.S. District Court Judge Thomas J. McAvoy in a trademark dispute case suggests that marketers may be within their rights when purchasing a rival's trademark as a keyword advertisement on a search engine, but are out of bounds when referencing a rival's trademark in their own ad copy.
