Judge: Whistle-blowers who claim union status can be protected

A whistle-blower who plausibly argues that he is speaking as a union representative is eligible for First Amendment protection against retaliation that is traditionally reserved for union leaders' discussions with other members, U.S. District Judge James Boasberg ruled. The ruling was applied in a case where a police detective spoke to a newspaper critically about his department but was not identified as a union representative.
