The solid-waste management district of Lake County, Ind., is seeking a legal opinion on the ownership implications of Powers Energy's proposed trash-to-ethanol plant. The deal between the district and Powers calls for the company to turn over the facility to the district once it is built, in compliance of a 2007 U.S. Supreme Court ruling. But Lake County's situation is "decidedly different" to the case referred to in the Supreme Court ruling, said Jeff Langbehn, the district chief. The lawyers are expected to submit their opinions in about a week, Langbehn added.
