Massey mine ducks federal enforcement takeover

A federal judge has ruled that a Massey Energy mine in Virginia didn't commit enough safety violations to merit a federal takeover, despite the mine having one of the worst violation and injury rates in the nation. The Mine Safety Health Administration director said the ruling showed "the system is broken," and that mines with chronic safety failings can evade federal shutdown.
