Judge's ruling sparks more debate over state renewables standards

A ruling by U.S. Appeals Court Judge Richard Posner questioning the constitutionality of requiring in-state sources to meet Michigan's renewable portfolio standard is adding to the debate over state renewable-energy targets. Anti-RPS groups say Posner's language could spur more lawsuits against such standards, but renewable-energy advocates say that's not the case. "This decision doesn't change anything on the question of state RPS design, as that question was not before the court," said Rob Gramlich, senior vice president for public policy at the American Wind Energy Association.
