Dismantling of DOMA opens door to myriad changes in health and retirement plans

Now that DOMA has been invalidated, advisers should be alert to the changes that their small-business clients will need to make to health benefit and 401(k) plans. Issues to look out for include the definition of "spouse" in health plans in light of the change in the federal definition, the tax treatment of benefits to same-sex couples and, for retirement plans, whether the DOMA ruling will be retroactively applied.
