U.S. asks court to reject NEA's suit against NCLB

The Bush administration asked a U.S. District Court judge to dismiss the NEA's lawsuit over NCLB, which alleges the law is an "unfunded mandate." In its filing, the administration says states choosing to accept federal funds may have to spend their own money to comply with the law. It also questioned whether the teachers union, its 10 affiliates and the six school districts that joined the suit could sue on behalf of states and districts nationwide.
