Analysis: Corzine case raises CEO culpability questions

The civil suit brought by the Commodity Futures Trading Commission against former MF Global CEO Jon Corzine puts the onus on the CFTC to prove that Corzine was negligent in his supervision, thus making him responsible for violations committed by his employees, writes Peter Henning of Wayne State University Law School. In addition, the agency will have to prove that Corzine acted recklessly in his management of the firm, a question unlikely to be decided before the case goes to trial, Henning writes.
