CMS seeks to end CME exclusion under Sunshine Act

The CMS has proposed a rule that would end the exclusion in the Physician Payments Sunshine Act that exempts drugmakers and medtech firms from reporting indirect payments to doctors for accredited continuing medical education. The reversal came after experts said the exclusion would allow firms to escape disclosure by shifting marketing funds from direct promotional programs to CME. The change would be "massively disruptive," said CME Coalition senior adviser Andrew Rosenberg.
