Employers should brush up on FMLA rules to avoid legal issues

A Smithway Motor Express employee who was awarded nearly $300,000 in back pay and damages for violations of the Family and Medical Leave Act should serve as a warning to other employers, says Jeff Nowak, a lawyer. Too many employers are not recognizing when an employee's request for leave may be covered by FMLA, which doesn't need to be specifically requested, Nowak says.
