Court: Biogenic sources are not exempt from EPA's carbon rules

A federal appeals court struck down a 2011 Environmental Protection Agency rule that temporarily excluded ethanol plants and other biogenic sources of pollution from greenhouse-gas regulations. "There is no statutory basis for exempting biogenic carbon dioxide" from the agency's rule, Judge David Tatel wrote in the decision by the U.S. Court of Appeals for the District of Columbia Circuit. The EPA said it would "review the decision to determine any next steps."
