EU questions aid to struggling German pharmaceutical companies

The European Commission is investigating the legality of a German program that exempts drug companies that are experiencing financial difficulties from paying required rebates to public sickness funds and private health insurers. Although regulations permit such exemptions for "particular reasons," the EC has noted that the German government's assistance to distressed firms does not comply with rescue and restructuring guidelines since it is neither limited in time nor part of a financial-restructuring plan.
