A brush with trademark law for toothpaste makers

Colgate-Palmolive took action in a simmering trademark dispute with rival GlaxoSmithKline, which makes the toothpaste Aquafresh, by asking a judge to rule that packaging on Colgate toothpaste doesn't infringe on trademarks used in Aquafresh branding. Specifically at issue is the "nurdle," industry slang for the graphical rendering of a single-use portion of toothpaste. Glaxo claims it developed the nurdle, while Colgate is arguing that it is commonly used in toothpaste ads and packaging.
