Judge: Proof of hate not needed for hate crimes charge

Prosecutors were correct to charge three men being tried for the death of Michael Sandy, a New York gay man, with hate crimes, even though there is no proof of anti-gay motivation, because they chose the victim based on his sexual orientation, a state Supreme Court judge has ruled.
