Texas challenges EPA's emissions "tailoring" rule in court

Texas filed a legal challenge against the Environmental Protection Agency's proposed "tailoring" rule, which seeks to restrict greenhouse-gas permitting to the biggest polluters while excluding nonindustrial sources. The plan is "arbitrary and capricious and is contrary to the Clean Air Act," argued Gov. Rick Perry in legal filings. Texas also argues that the tailoring rule would prompt, by Jan. 2, the reinterpretation or revision of its "state implementation plan."
