Lawyer: Commenting promptly on initial past-performance evaluations is key

A final rule issued by the Federal Acquisition Regulatory Council includes several changes, but it still reflects a 30-day period in which contractor comments on initial past-performance evaluations are allowed, lawyer Kara Sacilotto writes. "Contractors should be wary, however, of waiting until the last minute to provide comments on their initial evaluations," she writes. A provision in the National Defense Authorization Act for fiscal 2013 includes a 14-day comment period for contractors, and "once an evaluation is posted, it is available for other agencies to use in source selections," Sacilotto writes.
