Sun Capital pension ruling has broad implications for private equity

A recent appeals court decision holding that private equity funds can be held responsible for employee pension obligations of companies in which they invest could have consequences for the broader private equity market, experts say. The 1st U.S. Circuit Court of Appeals ruled that two investment funds run by Sun Capital Partners could be held liable for $4.5 million in pension liabilities of Scott Brass, a Sun Capital portfolio company that entered bankruptcy in 2008.
