Federal judge explains Whole Foods decision

Whole Foods and Wild Oats do not operate in a distinct market, and therefore their merger will not drive down competition, wrote the federal judge who dismissed the FTC's injunction to stop the deal in an opinion released Tuesday. The FTC, in an appeal made public Tuesday, said that the judge ignored Whole Foods CEO John Mackey's comments that the deal would indeed eliminate competition.
