The Federal Reserve will have to decide whether to approve Capital One's proposed acquisition of ING Direct, a move that would result in the fifth-largest bank in the U.S. Under the Dodd-Frank Act, the Fed must weigh the systemic risk that would result against the benefits of the deal. The central bank has yet to determine what would constitute a systemically risky acquisition, so its decision on the deal likely will have broad implications.
