Judge allows lawsuit against makers of cochlear implants

A family can continue its case against the manufacturer of cochlear implants after they malfunctioned in their son, a federal judge said. In July, the company settled an FDA administrative claim for $1.1 million but did not admit liability for using allegedly unapproved supplies that it voluntarily recalled in September 2004.
