The value of façade easements in cases involving donations of these easements as charitable contributions is a controversial area that consumes a lot of the Internal Revenue Service’s and the courts’ time. James A. Beavers, J.D., LL.M., CPA, CGMA, discusses a recent case in the Fifth Circuit in which the appellate court upheld the Tax Court’s valuation of the easement, but not its imposition of the penalty for grossly undervaluing it.
