A judge offered little encouragement to Apple on Thursday in its U.S. International Trade Commission patent suit against HTC related to data transmissions. "Clear and convincing means something to me. I have to be pretty darn certain a U.S. patent is invalid," said Thomas Pender, the ITC magistrate overseeing the case. Also at HTC, citing carrier support and a new design, a top company official expressed confidence in an interview that the Taiwanese phone maker's Windows-based smartphones will sell strongly against Apple and Samsung Electronics.
