Rehypothecation rules need clarification, experts say

The Working Group on Margining Requirements, a joint effort between the Basel Committee on Banking Supervision and the International Organization of Securities Commissions, recently released the final version of margin requirements for uncleared derivatives. The rules allow, under certain conditions, rehypothecation of collateral on uncleared derivatives. However, lawyers say the rules need to be clarified and might not be workable in some jurisdictions.
