Federal appeals court weighs in on Calif.'s LCFS

The 9th U.S. Circuit Court of Appeals affirmed the legality of California's Low Carbon Fuel Standard, overturning a district court's ruling that the standard violates the federal Commerce Clause. The appeals court also sent the case back to the district court for a trial on the standard's economic impact. The Renewable Fuels Association is among the plaintiffs in the lawsuit, which was filed against the California Air Resources Board in 2009.
