Labor Department announces changes to same-sex benefits policy

The Department of Labor announced Wednesday that married same-sex couples can participate in retirement and health care plans provided by their employer regardless of their state of residence. The terms "spouse" and "marriage" in the Employee Retirement Income Security Act should be interpreted to include same-sex couples, the department said. In a similar move, the Treasury Department recently announced that the legal marriages of same-sex couples would be recognized for tax purposes.
