Expert offers tips on keeping wellness plans legal

UpCounsel co-founder Matt Faustman offers three tips for determining whether an employee wellness plan is generally considered legal, beginning with the use of incentives rather than penalties. Programs should not require employees to meet specific health standards to avoid discrimination under the Americans with Disabilities Act, he said, but added plans that give employees a chance to qualify for a reward at least annually and keep rewards in line with government regulations generally should fall within the law.
