EU: A drug in one country can be a medical a device in another

The EU's Court of Justice has ruled that it is possible for a borderline product to be categorized as a drug or medicine in one country and as a medical device in another, thereby subjecting the same item to two different sets of regulations. It would even be possible for products using the same substance and mode of action to be marketed as both a drug and a medical device in the same country in certain instances, the court said.
