Cantaloupe trials may spell out scope of liability

The Colorado cantaloupe growers whose listeria-tainted melons were responsible for 33 deaths in 2011 have been charged with six criminal counts including introducing adulterated food into interstate commerce. While the Food Safety Modernization Act focuses on measures to boost outbreak prevention rather than punishment after the fact, the Jensen brothers' trial may determine whether any or all of the other parties in the food chain share in the liability for the deadly listeria outbreak.
