New York's Appeals Court to consider Bloomberg soda ban

The New York State Court of Appeals has agreed to hear the city's appeal of a lower court's decision to strike down a ban on sales of sugar-sweetened drinks bigger than 16 ounces at restaurants, stores, theaters and other venues. A state court ruled the ban illegal in March, the day before it was set to take effect, and in July a lower appeals court upheld the ruling. The ban, part of Mayor Michael Bloomberg's public health agenda, was opposed by soda companies and business groups including the restaurant industry.
