Supreme Court to consider Clean Air Act case

The U.S. Supreme Court is due to hear arguments soon on whether upgrades to aging coal-fired powerplants were in violation of the Clean Air Act. Environmentalists and construction interests will be watching the case, which will specifically look at whether the EPA properly interpreted the act's "new source review" rules when it found that 29 projects at eight Duke Energy generating units caused higher annual emissions.
