Report: Some FDA leaders object to pre-emption for drug suits

Several FDA scientists and career officials are opposed to the agency's stance favoring federal pre-emption in liability or personal-injury lawsuits filed by consumers against drug companies in state courts, according to internal documents released Wednesday as part of a congressional investigation. The approach appears "to be based on a false assumption that the FDA-approved labeling is fully accurate and up to date" in real time, an agency official wrote in a 2003 memo.
