Patent law's challenge system faces scrutiny

The America Invents Act, which overhauled the U.S. patent system, allows a patent to be challenged with the U.S. Patent and Trademark Office during the nine months after the patent is awarded. Critics say the system is problematic because going down that road may cost them the ability to challenge patents in court later. This aspect of the bill may have been a mistake, and some lawmakers are trying to change how the system works.
