PCMA CEO Mark Merritt urges regulators to officially determine that anti-kickback laws apply to ACA and copay coupons

A document posted by HHS seems to contradict a letter HHS Secretary Kathleen Sebelius recently wrote asserting that health plans bought through an Affordable Care Act exchange are not considered federal health programs and are thus not subject to anti-kickback laws. PCMA said that the document "appears to pivot away" from Sebelius' letter and that "regulators need to take the next step and formally determine what everyone already knows: that federal anti-kickback laws apply to the ACA."
