Sen. Grassley criticizes HHS on third-party kickbacks in ACA

Sen. Charles Grassley, R-Iowa, criticized HHS Secretary Kathleen Sebelius' position that health plans sold through Affordable Care Act exchanges are not subject to the same rules as federal health programs are. The decision "calls into question whether vital enforcement and oversight tools that ban rebates, kickbacks and bribes would be available ... to fight fraud," Grassley told Sebelius. HHS appears to be backing away from the stance, which would allow the use of drugmakers' copay cards and coupons, PCMA President and CEO Mark Merritt says.
